Adjustment of Status Guide (right after you arrived in the US)

If you are a K1-Visa holder, this is what you are supposed to do after you arrived here in the US of A.

1. Get SSN but if your I-94 is about to expire then wait for the GC or EAD.  They will not accept your application if I-94 is expired or about to expire in a few days.

2. Get married within 90 days and register it as soon as possible.

3. Finish your vaccination and have it transcribe by a USCIS registered doctor. Click below to search for a registered doctor in your area. (You will need the Vaccination Result Sheet from Saint Luke for your vaccination here).

Civil Surgeon Locator :Click Me

4. Meanwhile arrange the documents you will need for this application.

Here's is an extensive list of what would you need in order to ready your packet.

Note: I placed my documents in 3 separate transparent folders which I labeled outside with the corresponding purpose. This is to avoid the papers being misplaced, hence that after USCIS receives these 3 applications, they will forward it to 3 different offices for processing.

1st Folder - Adjustment of Status

* I-485 form
* check for $1010 made out to the Department of Homeland Security and attach to I-485 Form
* Photographs (2) of immigrant (passport type)
* Photocopy of birth certificate of immigrant
* Photocopy of passport biographical page and K1 visa page
* Form I-693 with the immunization section filled out by a US Civil Surgeon, signed and sealed by him.
* Photocopy of Form I-94 Arrival/Departure record (maybe stapled in her passport)
* Photocopy of I-797 Notice of Action, I-129 Petition Approval Notice or the NOA2
* Certified copy of Marriage Certificate
* Form G-325A Biographic Information Sheet (immigrant)
* Form I-864 Affidavit of Support (by USC)
* Employment letter of the petitioner
* 3 tax returns including copies of W2s (Photocopy) of the petitioner
* six recent pay stubs (Photocopy) of the petitioner

IF CO-SPONSOR is needed, plus this following documents:
* Form I-864 Affidavit of co-sponsor

* Proof of co-sponsors citizenship/status, ie US birth ceritificate, bio page of passport, naturalization papers, or LPR status
* Employment letter
* 3 tax returns including copies of W2s (Photocopy)
* six recent pay stubs (Photocopy)

2nd Folder - Advance Parole to Travel

* I-131 Form
* Statement of circumstances that warrant issuance of advance parole.
example:

I wish to apply for advance parole and obtain the necessary permission to travel to my home country prior to receipt of permanent residency status in the event of emergency or family illness. I do not have any specific plans to travel at this time.

Thanking you,

* Photographs (2) of immigrant (passport type)
* Photocopy of passport biographical page and K1 visa page
* Photocopy of Form I-94 Arrival/Departure record

3rd folder - Employment Authorization

* I-765 form
* Photographs (2) of immigrant (passport type)
* Photocopy of passport biographical page and K1 visa page
* Photocopy of Form I-94 Arrival/Departure record

When your packet is ready to shoot, then you would have to find the correct address on which you need to send the packet. It varies according to the location you are living at. Go to the website mentioned below to find out the USCIS office, that deals your area.

If you ever have to move to the new address, after filling of the AOS application, you need to inform USCIS by submitting AR-11 Form. You can do that online on this website
US citizen doesn't have to fill out AR-11 form but the other one USCIS has on its website.

hello po..
my friend already filed for her aos
and she said medical is not needed no more how true is that?

Wala nang medical pero may vaccine or immunization na lang. If you have completed the vaccines at Saint Luke then ok nang walang immunization.

Don't worry too much. It won't take long. It usually take 1 week. Same thing happened to my friend who lives in Davao. She submitted her Japan Police Clearance after her interview and got her visa after a week. Goodluck. Keep us updated.

The guide that was posted here would be very helpful to those who are going to US for application of Adjustment of Status. Steps by steps guide are very clear. List of requirements are also detailed. It would make the application easier. It was really a great help.

The process for adjustment of status is a three-step process. You have to go through these three steps to get permanent residency. This process can take several years to complete. The time this process can take to complete depends on the type of immigration you selected or the country to which you belong.

For immigrants adjustment of status may take longer than the expected processing times. The USCIS will evaluate the factors of your adjustment of support as a basis and it can be a lengthy procedure.
